London: For Benjamin Tooke, 1684. First Edition. Small Folio. The three tryals (trials) are bound together in a single volume since their lives were intertangled. Each with their own title page; 34pp, 78pp. and 56pp. In the development of English law, the Crown successfuly accused Sir Samuel Bardardiston of writing liberlous private letters. This case was one of the most celebrated in English law [see Stephens, History of Criminal Law, p. 313-314); In the letters, Bardardiston had questioned the existence of the "sham" popish plot and had criticized members of the government and the bench, including the judge, William Scroggs, who subsequently sat at Barnardiston's trial. Chief Justice Jeffreys was challenged by Bardardiston who in turn told the jury he had offered no proof of his allegations. It helps to understand that in the 1680's, judges and Crown lawyers disparagingly referred to questions of knowledge and malice as mere formalities. London: Benjamin Tooke, 1684. First edition. Cloth. Very Good. 12" by 7.5". None. A first edition copy of George Jeffreys' account of the trial of Sir Samuel Barnardiston, expertly rebound in cloth. Sir Samuel Barnardiston was an English Whig Member of Parliament and deputy governor of the East India Company, defendant in some high-profile legal cases and involved in a highly contentious parliamentary election. Barnardiston was summoned to trial on the 28 February 1684 for libel, accused of 'being of a factious, seditious, and disaffected temper,' and having 'caused several letters to be written and published' that reflected badly on the king and officers of state. Indeed, two of the four letters that formed the basis of the charge were privately addressed to a Suffolk friend, Sir Philip Skippon, and the others to a linendraper of Ipswich and to a gentleman of Brightwell, with both of whom Sir Samuel was intimate. Jeffreys was, of course, the notorious English judge. Here the defendant was accused of libel within a private letter and, shockingly, conviced by Jeffreys...just as shockingly, he was reversed by the House of Lords several years later. Overall, a handsome copy of another of Jeffreys' attacks on logic. Light shelf/edge wear, moisture stain at fore-edge of boards, slight curve to boards, textblock shows light even toning, moderate tidemarks, else tight and clean. Halfbound, burgundy leather spine and tips, marbled boards, light tan endpages. Small fo. 30pp (numbered through 34, but 9-12 dropped in, presumably, a printers pagination error, no loss of text).
